U.S. immigration law provides specific immigrant visas for different categories of people from foreign countries.

Employment-based green card preference categories include:

  • EB -3 - For professionals, skilled workers, and other workers with a labor certification and full time job offer
  • EB-4 - For "special immigrants," including religious workers
  • EB-5 - For business investors who invest a specific amount of money in a new U.S. commercial enterprise

Examples of people who could qualify for immigrant visas include:

  • Individuals who are leaders or who are at the top of their field in areas like the arts, sciences, business, athletics, or education. For these, there is the EB-1A visa.
  • People like the above but are considered priority workers. Qualifying individuals could receive the EB-1B visa, which is faster because these people are shown to be a higher priority. The EB-1B is also available for outstanding professors and outstanding researchers.
  • Individuals who are exceptional managers or executives, particularly those who are currently temporary residents under L-1A nonimmigrant visas. They could qualify for permanent residency under the EB-1C immigration visa.
  • Those with advanced degrees and experience or those considered to have exceptional ability in areas like science, the arts, business, athletics, or medicine. If they can be shown to qualify, for them there is the E-2 visa.
  • Workers with skill and at least two years of experience in their field. The EB-3 visa is for them and also for professionals who have college degrees.
  • Individuals whose admission to the United States would be considered to be in the national interest. For them, there is the NIW (National Interest Waiver).
  • Investors planning to invest money in the United States into new commercial enterprises. The EB-5 visa is for such investors.
