What are the Immigration Options for Investors?
To qualify as a U.S. immigrant investor, one must invest one of the following minimum amounts in a qualifying commercial enterprise:
- $1,000,000
- $500,000 in a target employment area, such as an area with high unemployment
Within the span of two years, this investment must create full-time jobs for at least:
- Ten citizens
- Permanent residents
- Or other immigrants who are authorized to work in the United States
This does not include the investor themselves and their immediate family members.
Understanding the categories of investment immigration visas is useful to see how you or your employees could qualify.
The visas that fall under the category of investment immigration include the following:
- The L-1A visa is one that can be used by foreign nationals entering the market in the U.S. to facilitate transfers of their employees from branches outside the U.S. to branches opening in the U.S.
- E-1 is for treaty traders. This may include foreign nationals in the U.S. or coming to the U.S. for substantial trading between his or her county and the U.S.
- E-2 is for treaty investors. Similar to the E-1 in nature, the E-2 differs in that it is for investors coming to run and develop operations they have invested in or are investing in.
- EB-5 visas are for foreign nationals who will create jobs by investing in the U.S. economy. The investment must be at least $1 million, or $500,000 for investments in high-unemployment or rural areas, and create no less than ten U.S. jobs. The EB-5 requires no U.S. company to petition for the immigrant.
